A General Terms and Conditions of Wu Wei Welt e.K.
§1 Scope of application to entrepreneurs and definitions of terms
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their valid version at the time of the order.A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor associated with self-employed (§ 13 BGB).
§2 Conclusion of contract, storage of the contract text
(1) 1) The following provisions regarding the conclusion of the contract apply to orders through our online shop http://www.wu-wei-shop.de as well as for telephone or oral orders through Ms. Sonntag or an employee.(2) In case of the conclusion of a contract, the contract is concluded with

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but rather an invitation to the consumer to order goods. By ordering the desired goods, the consumer submits an offer which is binding upon them to conclude a purchase contract.
(4) The following provisions apply when an order is received by our online shop: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.
The order is placed in the following steps:

Before submitting the binding order, the consumer may use the "Back" button in the internet browser used by them to return to the webpage where the customer's information is recorded and correct input errors or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by means of an automatically generated email. Only after sending an invoice do we indicate our acceptance of your offer and enter into an actual purchase contract. The exception to this is when ordering a ticket to attend an event or seminar. A contract between the customer and us (Wu Wei Welt) is only concluded pursuant to having sent the actual ticket to the customer.

§3 Prices, shipping costs, payment, due dates
(1) The prices listed include the statutory value-added tax (unless the ordered goods are to be sent to consumers in European countries) and other pricing components. Any shipping costs will be added separately.(2) The consumer has the option of paying by prepayment, direct debit, PayPal, credit card (Visa, Mastercard).
(3) If the consumer has chosen to pay in advance, they are obliged to pay the purchase price immediately upon conclusion of the contract. If the buyer is in default of payment, Wu Wei is entitled to demand default interest at a rate of 5% above the base rate of the European Central Bank. If Wu Wei Welt can prove that greater damages have been incurred due to default, Wu Wei Welt is entitled to claim said damages.
§4 Delivery
(1) Unless otherwise agreed, delivery will be made from Wu Wei Welt's warehouse or the publisher's distribution center (VAL) to the delivery address specified by the buyer. Please note that all information regarding availability, shipping or delivery of a product is only approximate and intended solely as a guideline. They do not represent binding or guaranteed shipping or delivery dates.(2) In the case of a purchase involving shipment, the risk of accidental loss of the sold item shall only pass to the buyer upon delivery of the item to the buyer.
§5 Retention of Title
We reserve the right to retain ownership of the goods until full payment of the purchase price has been received.****************************************************************************************************

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery charges (except for the additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive notification of your withdrawal from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the revocation of this contract, intact and in their original packaging. The deadline is considered met if you send the goods before the expiry of the fourteen-day period.
You bear the immediate cost of returning the goods.
Exclusion of the right of revocation:
The right of revocation does not apply to distance contracts
• for the supply of audio or video recordings if the delivered data carriers have been unsealed by the consumer, or
• for the supply of newspapers, periodicals, and magazines
• for the supply of tickets or participation entitlements to events.
(§ 312 g para. 2 sentence 1 no. 9 BGB stipulates that the consumer's right of revocation does not apply to contracts for the provision of leisure services if the contract provides for a specific date or period for the provision thereof).
Thus, every order for audio or video recordings (if unsealed), for magazines PIAFFE and PIAFFINO, and every order for tickets to an event (such as FEIRA, Soireè, Open House, Sunday Work, etc.) or a seminar (such as Escola de equitação, Intensive Days, Ligeira em familia, Three-Hearts Process, Alta Escola, etc.) is immediately binding upon order and obliges the customer both to acceptance and payment. Hence the right of revocation and return is excluded.

§9 Granting of rights, customer reviews
If the user decides to write a Wu Wei customer review, he grants Wu Wei an exclusive license for the duration of the underlying right, which is unlimited in time and space, for further use of the customer review for any purpose online or offline. Wu Wei will strive to always name the author (except if the author has indicated a desire to remain anonymous), but reserves the right to shorten or omit this information. Wu Wei reserves the right not to display a review on the website or to display it for a limited period of time, as well as to shorten or modify it. Customer reviews solely reflect the opinion of the customers themselves. Special General Contractual Terms and Conditions for Admission Tickets to Wu Wei Events or Seminars.
I. Scope, Contracting Parties
1. By purchasing an admission ticket or a ticket for an event or seminar of Wu Wei Welt, the purchaser enters into a contract with the organizer. The organizer is Wu Wei Welt e.K., Isabella Sonntag, Alleeweg 1, D-86875 Waal. This address is also the venue.
2. Only the following general terms and conditions of business apply to the contractual relationship between the organizer and the purchaser.
II. Contractual Content
The subject matter of the contract between the organizer and the purchaser is the right to attend the relevant event during the period specified on the ticket, whether as a course participant or as an audience member.III. Service Disruptions
a) If a service is prohibited due to official/legal orders in connection with a pandemic and is therefore not feasible, the organizer has the right to make up the service within 12 months after the obstacle to performance has been removed. The organizer does not lose their entitlement to payment if they offers the customer 2 alternative participation options within the specified period. This also applies if the customer rejects both alternate dates for any reason. Otherwise, a risk-sharing arrangement of 50% each applies; i.e. the customer is released from half of their obligation to pay the organizer for the services that have been canceled. b) In other cases of force majeure (e.g. natural disasters, armed conflicts, terrorism, etc.), the regulation under a) applies equally. The obstacle to performance ceases to exist as soon as and to the extent that the event is over and the organizer is able to resume their regular operations technically and personnel-wise. c) If the organizer is unable to provide services because resources fail unexpectedly and uncontrollably at no fault of their own (e.g. trainer falls ill at short notice, their flight is canceled at short notice, etc.), the organizer is entitled to make up the service within 3 months of the end of the outage without the customer's obligation to pay being waived. If the service is not made up by the deadline, the organizer will refund to the customer the portion of the fee related to the canceled service. d) Neither the customer nor the organizer has a right to terminate the contract in the cases referred to in a) to c) above. If, for personal reasons, the customer is unable to attend an already booked and paid-for event, the organizer is not obligated to refund the purchase price. In any case, the organizer reserves the right to charge a 10% cancellation fee.IV. Rules of conduct for the event, audio and video recordings
1. The courses and seminars require the full concentration of the trainer as well as the participating persons and especially the horses involved. For this reason, the organizer asks for participants to understand that bringing dogs to the event is generally not allowed. It is usually possible, however, to bring dogs to the equestrian center where the course will take place. However, it is forbidden to bring dogs into the riding arena during the course event, as this might well irritate or frighten the participating horses.2. Smoking is prohibited in the entire equestrian facility, except for specially designated areas. Instructions from supervisory personnel must be followed for safety reasons.
3. During the event, audio and video recordings of the event may be made by the organizer or persons commissioned by the organizer. Spectators/participants will also be visible in the video recordings. By purchasing the admission ticket, the purchaser declares that they agree to the making of such recordings. The rights to the recordings belong exclusively to the organizer or to third parties designated by them. The ticketholders or other visitors to the course event have no claims to exploitation, compensation or damages arising from the video recordings. The only exceptions to this are claims for damages arising from intentional or grossly negligent breaches of duty by the organizer or for damages resulting from injury to life, body or health.
4. It is prohibited for persons other than those expressly authorized by the organizer to make audio or video recordings during the entirety of the event. In the case of non-compliance, the organizer reserves the right to exclude the persons concerned from the event and to assert claims for damages.
V. Liability of the organizer
Any liability of the organizer for damages incurred by purchasers of the admission tickets and visitors to the event is excluded. This does not apply to damages resulting from injury to life, body or health that are due to negligent breach of duty by the organizer or an intentional or negligent breach of duty by his legal representative or agent, as well as for other damages resulting from a grossly negligent breach of duty by the organizer or from an intentional or grossly negligent breach of duty by a legal representative or agent of the organizer.
